Waiver Watchers ~

Per the CM consolidation to IPMG, Ascend has been trying to receive a copy of the submitted RFP under the Freedom of Information Act. To this date, IFSSA has not responded to our request. The reason for wanting to obtain this RFP is to determine who is the "front" company behind IPMG. Knowing the six case management owners who make up IPMG, there is no way they could have capitalized the start of a $15 million company. There has to be a "mother" company behind them and the rumor is, it is Mitch Roob's former company; ACS. ACS is the same company that IFSSA and Mitch Roob are wanting to award the claims processing contract to. This contract is the largest in state history at $1 billion.

If anyone has or can obtain this information, please let us know. I smell another sleazy deal going on. Below is the lastest email I sent to Mitch Roob and Peter Bisbecos concerning obtaining the RFP:

Dear Sirs ~

Ascend, Inc. had requested months ago under the Freedom of Information Act, a copy of the Case Management RFP that was submitted and accepted by IFSSA for waiver case management consolidation. To this date, we have not received a copy of the submitted & accepted RFP i.e. contract given to Indiana Professional Management Group. Please advice how a copy can be obtained. If IFSSA is going to put 170+ current case management companies out of business, we have a right to know exactly, who is putting us out of business.

Also, under this $15 million contract awarded to IPMG and through the Freedom of Information Act, we desire to know the legal name of the "front" company forming IPMG. It is well understood that the six current case management providers making up IPMG could not capitalize the formation of a $15 million company. Therefore, there must be a "mother" company backing IPMG and this is information the public has a right to know. It may be in the best interest of IFSSA and DOA to submit copies of the RFP in its entirity due to the massive rumors indicating that the "front" company of IPMG is Mitch Roob's former company; ACS.

From the Peter Bisbecos, Director, DDRS bulletin of 4/17/06, it indicates IFSSA/DDRS' goal is to have a contract with IPMG finalized by 7/1/06 and then a transition period where all waiver recipients will be forced to go with IPMG by the end of 2006. This bulletin solidifies that all freedom of choice of case management providers for waiver recipients will be terminated as of 12/31/06. CMS though, has indicated that if no choice is given under Indiana's Medicaid Waiver for case management services, then federal match monies cannot be obtained and all $15 million would come from Indiana's state funds. Is this issue being addressed under the contract negotiations with IPMG & CMS?

Lastly, will the $300 be paid back to each case management company that was given to IPMG during its formation to pay for "legal fees?" The $300 was given to the six IPMG companies by other case management companies (not part of IPMG) throughout the state with the promise of "hiring" once IPMG gained the contract. This appears to lean to the side of "extortion."

I would like to thank cjhelser for the persistent efforts to gain clarification of what the state is up to with the wavier program. Everyone needs a watch dog to nip at the heels of Mitch Roob, and the others that seem determined to take from the poor and give to the rich....or is that give to the Roob's???
It's sad that the people that actually use this service have the smallest voices of all when it comes to these changes. Well, actually, the whole situation is sad. It smells worse than a sewage plant on a warm, humid night. Thanks again, for being a well spoken, voice of sanity in a sea of drowning sailors!

This is the response we received per our request for a copy of the CM RFP. Interestingly, we are now receiving correspondence only from the legal counsel of the state. Mitch Roob and/or Peter Bisbecos will not respond. Below is the email I received from the Office of General Counsel per my request for the RFP:

Dear Ms. Helser:

We apologize for not responding to your request earlier. It may have possibly fallen through the cracks. The proposal submitted by IPMG still forms the basis of negotiation between the parties, and we are not able statutorily to release it at this time. (See IC 5-23-5-6; IC 5-22-18-4 (b) and (c), and 25 IAC 1.1-1-6.) As soon as a contract is fully executed, then that contract and the proposal upon which it was based become public records and can be viewed or copied by the public. A simple request can be made for these records citing the Access to Public Records Act (APRA), which is found in state statute.

Regarding your concerns about the makeup of IPMG and the companies that came together to form IPMG, most of the information you want can probably be had by contacting the Secretary of State's office. The general number there is (317) 232-6531. The office can also be accessed at www.in.gov/sos/. Articles of incorporation, as well as financial information concerning these companies, would be maintained by that office.
